These Terms & Conditions govern your access to and use of this website and any purchase you make from Helixius. By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the site.

These terms constitute an electronic record under the Information Technology Act, 2000 and do not require a physical signature. They form a binding contract under the Indian Contract Act, 1872, and are read together with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

2. Eligibility

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you are using this site on behalf of an organisation, you confirm that you are authorised to bind that organisation.

3. Products, specifications and pricing

• Product descriptions, dimensions, materials and images are indicative. Minor variations in colour, finish and dimensions may occur between the image and the delivered item.
• Prices are displayed in Indian Rupees (INR). Unless stated otherwise, prices are exclusive of GST, which is charged at the applicable rate under the Central Goods and Services Tax Act, 2017 and the Kerala State Goods and Services Tax Act, 2017.
• Delivery, installation and site-preparation charges may apply and will be confirmed in your quotation.
• We reserve the right to correct pricing or specification errors before accepting an order. If a corrected price is higher, you may cancel at no cost.

4. Orders and acceptance

Your order or enquiry is an offer to purchase. A contract is formed only when we confirm acceptance in writing (by email or order confirmation). We may decline an order — for example, where stock is unavailable, the delivery location is outside our service area, or the pricing was manifestly erroneous.

5. Payment

Payment terms are as stated in your quotation or order confirmation. Where advance payment is required, we begin fulfilment only once it is received. All payments are processed through the channels we specify — please do not remit funds to any account not confirmed by us in writing.

6. Delivery and installation

Delivery timelines, coverage and charges are set out in our Shipping & Delivery Policy. Timelines are estimates and are not of the essence unless expressly agreed in writing.

7. Cancellation, returns and refunds

Your cancellation, return and refund rights are set out in our Refund & Cancellation Policy, which forms part of these terms.

8. Installation, use and safety

Play and fitness equipment must be installed, inspected and maintained in accordance with the instructions and safety guidance we supply. We are not responsible for injury, damage or loss arising from:

• installation by a third party not authorised by us, or installation contrary to our instructions;
• use of the equipment outside its stated age range, weight limit or intended purpose;
• inadequate surfacing, site preparation, supervision, or failure to carry out routine inspection and maintenance;
• modification, misuse, vandalism, or normal wear and tear.

9. Intellectual property

All content on this website — text, images, logos, catalogues, designs and layout — is owned by or licensed to Helixius and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute or create derivative works from it without our prior written permission.

10. Acceptable use

You agree not to use this website to host, display, upload, publish or share any information that is unlawful, defamatory, obscene, infringing, harmful to a child, or otherwise prohibited under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We may remove such content and restrict access where required.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with any order is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential loss, including loss of profit or business interruption.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, or your rights as a consumer under the Consumer Protection Act, 2019.

12. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, floods, epidemics, strikes, transport disruption, or governmental action.

14. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to your statutory consumer rights — which allow you to approach the consumer commission where you reside or work — the courts at Kozhikode, Kerala have exclusive jurisdiction over any dispute arising from these terms.

15. Changes

We may amend these terms. The version number and effective date at the top of this page reflect the current version. Continued use of the site after a change constitutes acceptance of the amended terms.
